This privacy policy (“Policy”) describes how Arkansas 811, an Arkansas entity (“Arkansas 811”) collects, uses, protects and shares personal information of users of the web-based application (the “App”) and users of its website, www.arkansas811.com and the choices users have with respect to their personal information we manage. Through the App, Arkansas 811 provides platform for homeowners to request to have underground lines located and marked by utility providers (“Services”).  By using the Service and accessing the App, you acknowledge that you accept the privacy policies and practices set forth herein. If you do not accept these policies and practices, then you should not use the Service.

This Privacy Policy applies to our Users.  A User is a Person who accesses our App to view or manage farm data and for whom we may collect, retain and process User Data, which includes personally identifiable information and other information as explained more fully in this policy.


WHAT WE COLLECT & HOW WE USE IT

We respect your information, and our goal is to collect as little user information as possible while still providing Services to you.

Most guests of our site or our App provide information in the following ways:


Information You Give Us.

We collect information from you that help identify you, including your name, your email address, and login information (including password), as well as information that allows us to provide Services to you, including your phone number and your address information.  We also collect other information that assists us in providing a customized and personal user experience for you, such as your email notification settings and preferences, your device information, and information about when you access the App.

We also collect information about your project that will include digging, though this information should not normally contain personal information that would be a part of a privacy policy like this.  All of the information we collect from you is necessary to provide utility companies (our “Members”) with a notification to mark utility lines on your property.


Information We Get From Others.

We may get information about you from other sources. This information may include personally identifiable information, such as your name.  We may add this information to information we get from our App.

Information Automatically Collected.

We automatically log information about you and your computer or device. For example, when visiting our App, we log IP address, date and time of access, location information, browser information, operating system information and information about your use of and actions on our App. While you use the Services, we also collect information related to how you interact with us, such as your path through our App.  This information allows us to update our services and learn how we can better serve you and the residents of Arkansas more effectively.  Finally, we may receive information from you, like a confirmation, when you open emails from us.  This confirmation helps us improve our communications.


Cookies.

We may log information using "cookies." Cookies are small data files stored on your hard drive by a website. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our App.    This type of information is collected to make the App more useful to you and to tailor the experience with us to meet your special interests and needs.  Cookies are useful in keeping you signed in to our App.

Ticket Information, including information you provide us, such as your phone number, address, and name, is available online through our Ticket Search or Find Ticket feature.  All ticket information is public, but requires the ticket number we provide to you when you provide information to us.  Without the specific ticket number, it is difficult to access your information.


We do not sell or trade your personal information with others.  We share personal information as follows with certain third parties to provide the Services to you or to comply with our obligations:

  • We share your information with our Members (i.e. utility companies) so they can mark utility lines on your property.
  • We may share aggregate or anonymous data (including data that has had personally identifying characteristics, like your name or address, removed) with third parties as part of providing our Services.
  • We may share personal information when we do a business deal, or negotiate a business deal, involving the sale or transfer of all or a part of our business or assets. These deals can include any merger, financing, acquisition, or bankruptcy transaction or proceeding.
  • We may share personal information for legal, protection, and safety purposes.
    • We may share information to comply with laws.
    • We may share information to respond to lawful requests and legal processes.

STORAGE OF INFORMATION

Your information collected through the App is processed in the United States, where Arkansas 811 service providers maintain facilities. If you are based in the United States and use our App, you consent to have your data processed by Arkansas 811 in the United States.

Arkansas 811 maintains administrative, technical and physical procedures to protect information processed via our servers. Access to information is limited (through user/password credentials and two factor authentication) to those employees who require it to perform their job functions. We maintain your information to provide our Services and to maintain records of the Services.  When we no longer require your information for maintaining your account’s past data history, we may delete your information.
